Presenter's Biography:

Angela has a broad commercial chancery practice, representing corporations and individuals in complex disputes. Her core practice areas are company and commercial, probate, family trust, and defamation. Her expertise also extends across personal injuries and fatal claims, death inquests, property disputes, securities and finance, professional disciplinary actions, as well as injunctions.

Aside from litigation, Angela is a Fellow of the Chartered Institute of Arbitrators and she obtained the 2023 Diploma in International Commercial Arbitration from the CIArb. Angela has experience of acting for parties in commercial and aviation arbitrations. She is on Bar List (Arbitrators) of the Bar Association.
 
Objective:

This course focuses on how courts assess and award damages in online defamation cases, and the unique challenges posed by the digital environment. Participants will explore how reputational harm is quantified when defamatory content spreads rapidly and globally online and the limitations of these awards. The course also provides practical strategies for pleading, proving, and contesting damages in internet defamation disputes.

Participants will also examine how courts approach the valuation of reputation in the age of viral media, considering factors such as the scope of publication, the difficulty of retraction, and the role of apology or correction. The seminar will provide both a theoretical and practical framework for navigating damages claims in a way that aligns with current judicial thinking and procedural expectations.

    • Anonymity and jurisdictional challenges.

  • Overview of types of damages in defamation (general, aggravated, exemplary).

  • Recent Hong Kong case law on damages in internet defamation.

  • Comparative insights: Damages awards in the UK, Australia, and the US.

  • Practical issues:
    • Proving serious harm in digital defamation.
    • Handling issues of apology, retraction, and mitigation.


  • The future of defamation damages: platform liability, algorithmic amplification, and reputational harm from AI content.
