Presenter's Biography:

Louis focuses on a mixed practice with civil and criminal law. He has appeared in his own right in all levels of court up to the Court of First Instance.
Louis worked in multinational technology companies before joining the Bar. He was responsible for technology consulting, IT auditing and advisory. He has extensive knowledge of technology and cybersecurity. Louis was a mental health counselor as well. He has experience conducting psychological assessments and psychotherapy.
 
Objective:

The rise of autonomous AI systems challenges the very foundation of criminal law. How do we assign blame when an algorithm, not a person, commits a criminal act? Traditional legal concepts like actus reus (the act) and mens rea (the intent) were designed exclusively for human agents.
This seminar confronts this urgent legal paradox. We will analyze the core criteria for criminal liability in the context of AI, examining real-world cases like the Random Darknet Shopper. Critically, we will move beyond problem diagnosis to focus on the regulatory imperative: building a legal framework that can fairly address automated misconduct and prevent future harms.

  • Deconstructing Liability: Can an AI system ever satisfy the legal requirements for a crime (Actus Reus and Mens Rea)?

  • Case Study: Analysis of the "Random Darknet Shopper" and its implications for algorithmic accountability.

  • Future Legal Status: Exploring the concept of Juridical Personality of AI to determine its rights and obligations.
