Presenter's Biography:

Chester was called to the Bar in 2020 and is a member of Sir Oswald Cheung's Chambers. He practices in land and property matters, including building management disputes. Other than the Court of Appeal, Court of First Instance and District Court, he has also appeared in the Lands Tribunal and Building Appeal Tribunal.
 
Objective:

This course aims to summarize selected building management cases in the past year to help practitioners stay up-to-date on the latest developments of this area.

While this course is intended to be a case update rather than a comprehensive review of all building management issues, there will be discussions to explore the issues touched upon in these cases. Where appropriate, there will also be sufficient summary of the relevant area of law so as to enable participants to grasp the significance of the issues discussed in the cases and to anticipate some potential problems arising from these issues in future cases.
 
Outline:

The format of the course will be a series of case updates, organized by the relevant issues to ease the participants' understanding. Summary and commentary on the law will be given at the appropriate time to allow participants to understand the significance of the issues discussed.

Some key building management issues addressed by these cases include:-

  • Construction of conveyancing documents
  • Adverse possession in the building management context
  • Waiver, estoppel, acquiescence in the building management context
  • Considerations of illegality in the building management context
  • Quasi-easement
  • The element of reasonableness in construing rights and duties in the building management context
  • Other miscellaneous matters under the Building Management Ordinance (Cap. 344) or Buildings Ordinance (Cap. 123)
