Marcus spent decades as a partner of a leading offshore law firm, advising international trust companies, high net-worth families and their advisors on estate and succession planning, trust and foundation structuring, family governance, charitable structures and philanthropy, wills, probate and estate administration.

He possesses deep expertise in trusts, foundations, companies, partnerships and other private wealth vehicles - and understands how these structures evolve as family members move through different life stages. He is particularly adept at tailoring bespoke solutions to the unique needs of Asian families.

Today, Marcus serves as an independent consultant, drawing on his extensive knowledge and experience to guide families around the world every aspect of wealth planning and governance.

He is an admitted Advocate of the Royal Court of Guernsey and BVI solicitor. He is also admitted as a barrister and solicitor of the High Court of New Zealand and as a solicitor of the High Court of England and Wales.
 
Objective:

This seminar is for practitioners working in private wealth industry serving affluent families with global presence to provide them with a quick overview of various private wealth structures such as company, trust, foundation and limited partnership across premier jurisdictions. The focus is to provide practical guidance on tailoring each structure to a family's unique circumstances and adapting or re-structuring over time as needs evolve with real-life case studies that illustrate best practices and common pitfalls.
 
Outline:

Part 1 will cover a quick overview of various private wealth structures:

  • Company
  • Various types of trust - full discretionary, fixed, reserved power, VISTA, STAR, Foreign grantor trust, granny trust, unit trust
  • Foundation
  • Limited partnership



Part 2 will provide practical guidance on technical knowledge and client skills:
  • Essential factors in designing a structure
  • What a structure can and cannot achieve
  • Why, when and how to re-structure
  • How to get client talk and listen
  • Key criteria for selecting the right trustee or service provider
  • Emerging issues and common mistakes in structuring and re-structuring


Part 3 will go through some case studies on the following topics
  • Structuring for illegitimate children and cross-border issues: Jacky Zong and others v Kelly Fuli Zong and another (HCMP 2772/2024) [2025] HKCFI 3355
  • Restructuring for multigenerational family: HSBC Trustee (CI) Limited v Siu Hing Kwong and others [2017] JRC214A
