Presenter's Biography:

Nicholas Pirie has been practising at the Bar for more than 40 years in Hong Kong. He maintains a civil practice with a focus on personal injuries, particularly medical negligence. He has also acted in a wide range of other common law and commercial matters at all court levels, including the Hong Kong Court of Final Appeal and the Privy Council. This has included claims against solicitors and other professionals for negligence. In the last year, he has dealt with international sales of goods and other commercial cases in the Hong Kong International Arbitration Centre. He was former chairman of the Hong Kong Bar Association Committee for Personal Injuries and Insurance.
 
Outline:

  • This talk will deal with changes to the duty of care which have arisen over the last 5 or so years, to a more nuanced approach, often based on the contents of a professional conversation with the client.

  • How far have clinical negligence cases changed the concepts now adopted in non-clinical professional negligence claims which involve pure economic loss.

  • How Far Has the duty of Care of the Professional been affected by the Decisions of Montgomery v. Lanarkshire Health Board, (2015 UKSC 11 , Hughes -Holland v. BPE Solicitors (2017) UKSC 21 , Manchester Building Society v. Grant Thornton (2021) UKSC 20, Khan v. Meadows (2021) 21?

  • Has the scope of the duty of care in these professional negligence cases affected the consequent damage awards?

  • Has the SAAMCO principle been extended across all areas of professional practice? Has it been adopted in Medical Negligence Cases?

  • What happens when the client wants advice and there is a discussion?

  • Conclusions
