Presenter's Biography:

Alison has a broad civil practice, concentrating on the following areas: family, personal injuries and land. In her family law practice, she often advises clients on surrogacy law.
She is regularly appointed as a mediator in a wide range of matters, such as family, personal injuries and general civil disputes.

She was a contributor (or co-contributor) of various chapters of the Annotated Ordinances, and the chapter on "Right to Family" in Law of the Hong Kong Constitution (3rd Edn., 2021), as well as editor of Constitutional and Human Rights Law in Hong Kong (Halsbury's Special Edition) (2015).
 
Objective:

To enable participants to gain an understanding of when and how the Parent and Child Ordinance (Cap. 429) ("PCO") might be used to provide solutions for parents and children who require declarations or orders in respect of their parentage or parent-child relationship.
 
Outline:

Enacted in 1993, the PCO seeks "to reduce the legal disabilities associated with illegitimacy, to consolidate and amend certain aspects of the law relating to paternity, legitimacy and legitimation, to provide for the determination of parentage in cases where birth or pregnancy results from medical treatment services, to provide for the use of scientific tests in determining parentage in court proceedings".

This course will examine

  • Recent PCO cases
  • What kinds of court orders may be made under the PCO, such as-
  • declarations of parentage
  • parental orders relating to children born out of surrogacy arrangements
  • Practical tips and latest industry updates
