Presenter's Biography:

Lincoln's practice comprises litigation and advisory work in various civil matters, with particular emphasis on commercial disputes, banking and finance, personal injuries and disputes over ownership of land and family property. He is also experienced in liquidation proceedings and company matters, having represented clients in winding up proceedings and shareholders disputes. He is regularly instructed to appear in court and has appeared at all levels from Appeal Boards, Tribunals to the Court of Final Appeal. In addition to court proceedings, Lincoln has been involved in arbitrations and enforcement of arbitral awards. Besides, Lincoln has been instructed to advise various companies in relation to IPO and listing matters in HK (Main Board & GEM) and overseas capital markets.

Before Lincoln was called to the Bar, he had worked in various financial institutions including the Goldman Sachs (Asia) LLC and the Bank of China (HK) since 2001. He was a Legal Trainee (Barrister) of the Department of Justice (DoJ) and upon the completion of pupillages with Mr. Peter Duncan SC and Mr. Victor Dawes SC, Lincoln commenced practice in 2010.

Kin is keen on developing a broad civil law practice with particular emphasis on land-related disputes and commercial litigation. He is regularly instructed to appear in court and has appeared at all levels of courts in Hong Kong. In addition to court proceedings, Kin has been involved in arbitrations and enforcement of arbitral awards involving disputes with cross-border and international elements.

Apart from contentious works, Kin has also been instructed on a regular basis to advise various companies in relation to IPO or listing matters in Hong Kong. Kin has also been instructed to advise on the publication of NFTs and other crypto-assets under the current regulatory regime pursuant to the Anti-Money Laundering and Counter-Terrorist Financing Ordinance (Cap.615)
 
Objective:

To provide an overview of the current land compulsory sale regime under the Lands (Compulsory Sale for Redevelopment) Ordinance (Cap. 545) (the "Ordinance") with reference to recent case laws and to discuss on how the recent legislative amendments to the Ordinance (which is expected to take effect in mid-December 2024) will impact on the current landscape and what are the practical implications.
