Presenter's Biography:

Nelson Miu received his BS degree from Yale University, and his LLB and LLM degrees from the University of London. He was called to the Bar by the Honourable Society of Gray's Inn in 1988. He joined Sir Oswald Cheung's Chambers in 1989 and has been in continuous practice in Hong Kong ever since. He specializes in contentious probate and trusts.
Nelson Miu has since 2008 been the External Examiner/External Academic Advisor for Property and Probate Practice for the PCLL courses of the 3 local universities. He is currently Chairman of the Bar's Committee on Land, Trust and Probate.

Chantel was called to the Bar in 2014 before she received LLB (First Class) in Guangdong University of Finance and Economics, MCL (HKU), MA (University of Bristol) and PCLL (HKU). Chantel obtained Middle Temple Scholarship, Leslie Wright Scholarship and China-appointed Attesting Office Scholarship totalling 17 scholarships throughout her legal studies. She has been appointed as a China Legal Consultant of Jiangsu FD Yongheng Law Firm of PRC since 2016. Her main areas of practice include PRC cross-border litigation, property litigations, trusts and probate litigations, company and commercial disputes. Chantel is also a Contributing Editor to Butterworths Hong Kong Probate, Administration and Trustee Handbook (4th Edn, 2016), The Hong Kong Encyclopaedia of Forms of Precedents: Trusts (2nd Edn, 2017) and The Hong Kong Encyclopaedia of Forms and Precedents: Wills and Probate (2nd Edn, 2018).
 
Objective:

This course aims to serve as an updated introduction on common issues that may arise in contentious probate and administration proceedings. This includes the proving/construction of a contested will, removal of executor/administrator and other proceedings related to the estate of a deceased person. The course also offers practical advice on professional duties to solicitors in the preparation of a will.
 
Outline:

1. Interlocutory issues: Application for special grants, Beddoe Order, Caveator Proceedings

2. Removal of personal representative and revocation of grant

3. Issues arising from the contentious probate

4. Updates on cases of administration proceedings and probate action.

5. Updates on trust claims
